Summary of Wind River Settlement

 

On June 20, 2005, Green Hills Software and Wind River Systems announced that they entered into a settlement resolving all outstanding litigation between the companies.

Claim Resolution
Breach: Wind River sued Green Hills Software claiming that Green Hills Software had breached the 1992 and 1993 agreement and was no longer entitled to receive VxWorks The 1992 and 1993 agreements are still in place and Wind River will provide Green Hills Software with VxWorks
Access to INTEGRITY: Wind River claimed it was entitled to Green Hills Software’s INTEGRITY operating system Wind River abandoned its demand
Antitrust: Green Hills Software sued Wind River for antitrust violations based on Wind River’s failure to provide VxWorks to Green Hills Software Wind River will provide Green Hills Software with VxWorks
False advertising: Green Hills Software sued Wind River for false advertising for its claim to have “the first and only cross-platform IDE to support VxWorks, Linux, and in-house proprietary operating systems,” despite the fact that Green Hills Software provided such a solution years before Wind River Wind River has stopped making this claim
Trademark infringement: Green Hills Software sued Wind River for infringing Green Hills Software’s MULTI trademark because Wind River was using the term “Multi X” in conjunction with its debugger product Wind River has agreed to stop using the term Multi-X
